What really happened in Congo? Here is some info on the case.

What amazed us in this case is that the investigation and the media have based their stories on the so called witnesses’ version in the murder case. (look in the section articles)

There is hardly anyone who has tried to investigate this from Tjostolv and Joshuas’ side. What if the media and investigators would give their version a chance? We are after all talking about the death penalty that may be overturned into lifetime sentences.

In this page we will bring information that can help see the murder case from a different perspective than the “witnesses”.

 

The driver was shot from the left

The missionary named Bregård who has grown up in Congo, and has lived most of his adult life in this country, told me some time ago something important regarding Kasongo, the dead driver. Both the driver’s brother and the investigators told Bregård that the entrance wound was close to the ear on the left side. The exit wound was on the right side and fairly big. Bregård speaks the language and doesn’t need translation. Rune Edvardsen (from the Dina-foundation) heard the same, but needed translation.

 

The “murder weapon” and the gun has been in Norway the whole time

Since August, Norwegian media has been informed that two of the weapons that the Congolese investigators and prosecutors claim Tjostolv and Joshua took with them into Congo, has been in Norway the whole time. This is the so called “murder weapon” and a pistol (found on pictures from the camera or cellphone). It wasn’t until the lawyer Furuholmen got engaged and got help from a journalist from TV2 that the weapons were easily found where they were supposed to be, in Norway. Is the media really not interested in this type of facts? We are after all talking about death penalties against the two men, but headlines that sell are probably more interesting to the press. Below you can read two quotations from the media about this case.

VG October 28th 2009:

Quote: “During the trial…. pictures of two weapons were presented as evidence. The court claimed they had proved that the norwegians had the two weapons, a rifle and a 9mm pistol with them into Congo in addition to the shotgun.”

VG goes on by telling that the shotgun was found and it’s stated that this is not the murder weapon.

In the judgement papers, page 21 the judge has indentified the murder weapon. This is a weapon that refers to a photo.

TV2 october 28th 2009:

Quote: “TV2 has traced the weapons… The gun can be traced back to the Crown Prince’s residence Skaugum. The fall of 2006 Tjostolv served in the Royal Guard. When he was stationed at Skaugum Tjostolv says he took a picture of the gun with his cell phone. Sources in the Norwegian Defence confirm that there was a weapon like this at Skaugum when Tjostolv served there. This gun has never been reported missing, and is still in the Norwegian Defence possession.

The other gun that the Congolese police think is the murder weapon, TV2 got access to in a forest outside of Oslo on Tuesday. The serial-number on the gun is identical to the number on the gun Tjostolv and Joshua poses with. This is a soft-gun – a weapon that uses rubber bullets. It’s not possible to use sharp bullets in this gun. This is therefore not the murder weapon.

 

Other killers has been named

The information below came to the Norwegian embassy in Angola in the middle of October. The source is considered credible by the Foreign Ministry. The source is working in an international organisation. For safety reasons we don’t write the name or what kind of work this person does. The information was written in French and e-mailed. The e-mail was translated to norwegian by someone at the Embassy in Angola.

The text is printed exactly as lawyer Furuholmen received it on October 29th. (We show both the original text in French, and the authorized translation into English here)

"Wednesday, 14 October 2009
A credible contact has been in touch with me providing information relating to the 2 Norwegians accused of having assassinated their driver and condemned to death in Kisangani.
The story goes as follows:
In the middle of September, in the military jail in Kisangani, a military prisoner was witness to a discussion between 3 other military prisoners who were being held on other charges, blaming themselves for having messed up an ambush aimed at stealing money from 2 foreigners. The two foreigners are the Norwegians referred to above who, having just arrived in Kisangani at the start of April 2009 on a risk assessment mission for a travel agency, contacted their driver and asked him to undertake a trip to establish the security situation in the region of Kisangani and Haut-Uélé. The driver immediately told a soldier friend and together they decided to approach 5 other soldiers to plan and lay an ambush with the aim of stealing the foreigners' money. Once the preparations for the ambush had been made, these 6 soldiers then waited for the signal from the driver (date of departure and location) to put their plan into operation. Sometime in April, at the location of the sprung ambush the soldiers started firing to frighten the foreigners and a stray bullet killed the driver. The soldiers immediately fled and in the course of flight, along the way, they accused the two foreigners of having killed their driver, making this statement to a peasant who notified the police. At the moment, the two Norwegians are in detention, waiting to be transferred to Kinshasa. Of the 6 soldiers implicated, 4 are being held in Kisangani prison and the other two are being held in a secret ANR prison (ANR - National Intelligence Agency).

Following on from the information provided on Wednesday, 14 October 2009 concerning the 2 Norwegians being held for the assassination of a Congolese driver in Kisangani, the contact has supplied me with the names of two of the six soldiers who laid the ambush. The person in charge of setting up the ambush is Second Lieutenant BAYILOGANDE, with the assistance of Sergeant Michel AMULI. These two soldiers are currently being held in the Kisangani military prison on other charges. They were members of the Military Police Battalion of the 7th Military Region of Kisangani when they made the plans to lay an ambush acting in collaboration with the driver who was killed."

 

They were to be scared

From another source that I don’t want to name, I (Kari Hilde French) heard a story that confirms the story above. That there were others who were involved in the killing of the driver Kasongo.

I was told that the boys were in Congo for some reasons. They were going to investigate something, but backed out. Therefore someone wanted to scare them. The driver was part of the plot. Everything got out of control. The driver was killed by accident by the attackers and Tjostolv and Joshua managed to escape.
